Panel to examine US anti-dumping measures on Chinese shrimps and sawblades

At its meeting on 25 October 2011, the Dispute Settlement Body (DSB) established a panel to review US anti-dumping measures imposed on Chinese shrimps and diamond sawblades.

The DSB established a panel to examine US anti-dumping measures imposed on Chinese shrimps and diamond sawblades.  Following the procedural agreement reached between the two parties (WT/DS422/4), the US accepted the establishment of a panel at China’s first time request (WT/DS422/3).

China said that consultations held with the US on 11 May and 8 September 2011 regarding the US zeroing practice in its anti-dumping investigations on Chinese shrimps and diamond sawblades failed to resolve the dispute. China added that the application of zeroing in calculating the margins of dumping by the US had been repeatedly declared WTO inconsistent by various panels and the Appellate Body. China informed the DSB of the procedural agreement concluded with the US, which, according to China, would ensure the proceedings move smoothly and quickly and would contribute to the prompt settlement of the dispute. 

The US said that the initiation of this dispute was unnecessary. The US was pleased about the procedural agreement concluded with China which according to the US would expedite the proceedings and decrease the burden on the parties and the system. The US noted that its Department of Commerce had discontinued zeroing in the context of average-to-average comparisons in investigations.

The EU, Korea, Japan, Honduras, Thailand and Viet Nam reserved their third-party rights.

Adoption of annual report 

The DSB adopted its annual report (WT/DSB/W/460 and Add.1) which outlined the actions taken by the DSB since the previous annual report (WT/DSB/51). This report has been prepared according to the Procedures for an Annual Overview of WTO Activities and for Reporting under the WTO (WT/L/105).

Next meeting

The next meeting of the DSB will be held on 18 November 2011.
